1. About us
This website is operated by Neil Terry Photography, an independent photography business based in the United Kingdom.
Website: https://neilterryphotography.co.uk
For enquiries about orders, products or licensing, please use our contact page:
These Terms and Conditions apply to purchases made through our online shop. They do not automatically govern separately negotiated photography assignments, editorial licensing or commercial licensing agreements.
2. Products
We sell photographic products including calendars, greeting cards and photographic prints.
We may also offer digital photograph downloads for personal, non-commercial use.
We make reasonable efforts to ensure that product descriptions, photographs, prices and availability are accurate. Colours may vary slightly depending on screen settings and printing processes.
Product availability is subject to stock levels and any applicable production arrangements.
3. Prices and payment
All prices are displayed in pounds sterling (GBP).
The total price, including any applicable delivery charges and taxes, will be shown before you place your order.
Payment must be made using one of the payment methods available at checkout.
Promotional offers, discounts and bundle prices are subject to the conditions displayed with the relevant products or offers.
We reserve the right to correct genuine pricing errors. If an error affects an order that has already been placed, we will contact you before proceeding and offer you the choice of accepting the corrected price or receiving a refund.
4. Placing an order
When you place an order, you are making an offer to purchase the selected products.
You will receive an email acknowledging your order. A contract is formed when we confirm acceptance of your order, normally through an order confirmation or dispatch notification.
If we cannot fulfil an order, we will contact you and arrange an appropriate refund.
Please ensure that the delivery and contact information you provide is accurate.
5. Delivery
Physical products are delivered using the shipping services and charges displayed at checkout.
We aim to dispatch orders promptly, although delivery estimates may vary depending on stock availability, production requirements, postal services and seasonal demand.
Unless a different delivery period has been agreed, goods will be delivered without undue delay and within 30 days of the contract being formed.
We remain responsible for goods until they are delivered into your physical possession or that of a person you have nominated, except where you independently arrange a carrier not offered by us.
If an order is delayed, lost or arrives damaged, please contact us so that we can investigate and provide an appropriate remedy.
6. Cancellations, returns and refunds
Customers purchasing most physical products online have a statutory right to cancel within 14 days of receiving their order.
In addition, Neil Terry Photography offers a voluntary 30-day returns period for eligible physical products.
Our full cancellation, returns and refund arrangements are explained in our Refund and Returns Policy, available through the website.
Nothing in these Terms and Conditions or our Refund and Returns Policy restricts your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.
7. Photographic prints
Photographic prints may be produced after an order is placed and may be offered in different standard sizes.
Choosing a standard print size does not automatically remove your statutory cancellation rights.
Where a product is genuinely personalised or produced to individual specifications, an exception to the normal change-of-mind cancellation right may apply. Any applicable exception will be clearly identified before purchase.
Faulty, damaged or incorrectly supplied prints remain subject to statutory consumer protections.
8. Digital photograph downloads
Where digital photographs are offered through our online shop, they are supplied under a personal-use, non-commercial licence.
The customer is permitted to download and retain the purchased file and use it for personal purposes, including producing physical prints for private use.
Purchasing a digital photograph does not transfer copyright or ownership of the intellectual property.
Customers must not, without separate written permission:
- Resell, redistribute or sublicense the digital file.
- Make the file available for others to download.
- Use the photograph for advertising, marketing or other commercial purposes.
- Publish the photograph in newspapers, magazines, websites or other editorial publications.
- Claim authorship or ownership of the photograph.
Additional licences, including editorial and commercial licences, may be available by contacting Neil Terry Photography directly. These are negotiated separately and are not sold through the online shop.
Where customers expressly consent to immediate delivery of digital content and acknowledge the loss of their statutory cancellation right once supply begins, that right will end when supply begins.
The necessary consent and acknowledgement will be obtained before immediate digital supply.
Your statutory rights concerning faulty digital content remain unaffected.
9. Copyright and intellectual property
Unless otherwise stated, photographs and other original creative content displayed on this website are protected by copyright and remain the intellectual property of Neil Terry Photography or the relevant rights holder.
Purchasing a physical print, calendar or greeting card does not transfer copyright in the underlying photograph.
No reproduction, commercial publication, distribution or licensing rights are granted unless expressly agreed in writing.
Requests for editorial, commercial or other photographic licences should be made directly through our contact page.
10. Faulty products and consumer rights
All goods supplied must meet the standards required by applicable UK consumer law, including being as described, of satisfactory quality and fit for their intended purpose.
If a product is faulty, damaged or incorrectly supplied, you may be entitled to a refund, repair, replacement or other remedy, depending on the circumstances.
These rights also apply to discounted products.
11. Website information
We aim to keep the website accurate, accessible and available.
We may update product information, prices and website content from time to time.
Nothing in these terms excludes or restricts liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability arising under mandatory consumer protection legislation.
12. Privacy and personal information
Personal information provided when placing an order or contacting us will be handled in accordance with our Privacy Policy.
Our Privacy Policy and Cookie Policy are available through the website.
13. Changes to these terms
We may update these Terms and Conditions to reflect changes to our products, services or applicable law.
The terms applicable to an order will normally be those in effect when the relevant contract is formed. Changes will not retrospectively remove customers’ existing contractual or statutory rights.
14. Governing law
These Terms and Conditions are governed by the laws of England and Wales.
Nothing in this section removes any mandatory consumer protections or rights to bring proceedings in a court that would otherwise apply to a customer under relevant law.
